Warum keine Bucheinbände in den Rezensionen?

Leider ist das deutsche Urheberrecht dumm und erlaubt nicht, dass eine Rezension eines Buches das rezensierte Buch abbildet. Die Begründung liegt darin, dass das Zitatsrecht nur die Verwendung von Zitaten, also auch von Bild-Zitaten, erlaubt, wenn sich das Werk mit dem Zitat auseinandersetzt. Da aber der Einband als anderes Werk angesehen wird als das Buch selbst, kann eine Buchrezension nicht den Einband verwenden.

Wenn in der Rezension ein Kommentar zum Einband stehen würde, wäre die Abbildung des Einbands über das Zitatsrecht (§51 UrhG) abgedeckt. Und wenn ich die Bücher verkaufen würde, wäre es auch ok, das Produkt abzubilden (§24 MarkenG, vgl. insb. BGH, 15.02.2007 - I ZR 63/04). In beiden Fällen jedoch natürlich nur selbstgemachte Fotos.

Da es mir wirklich zu dumm ist, in jede Rezension eine überflüssige Floskel zum Bucheinband zu verlieren (tut mir Leid, lieber Einbandsgestalter, aber ich bin kein Bildkritiker), ebenso wie alle meine Bücher für eine Million Euro das Stück anzubieten, verzichte ich auf solche rechtlichen Spitzfindigkeiten und stelle halt kein Bild ein.

Es gehört zu den idiotischsten Auswirkungen des Urheberrechts, dass kostenlose Werbung illegal gemacht wird.

Why no Real Book Cover in the Reviews?

Sadly, German copyright is so stupid to forbid reviews to display a book cover of the book at hand. The reasoning is that quoting a copyrighted work is fine for the purpose of a review, but the book cover and the book itself are different works of art, and the book review does not address the cover.

If my reviews would talk about the cover as well as the book, I would be allowed to put pictures of the cover to the review. Also, if I intended to sell the books, I could do so, too, as I may depict an item I wish to sell, even if I do so privately. In either case, it would have to be self-made photos, of course, not photos made by someone else.

As I would feel incredibly silly to add a superfluous opinion regarding the book cover to every review (sorry, cover designers, but I'm not a picture critic), and equally silly if I'd offer to sell my books for a million euros each, I simply decided to avoid such trickery and simply do not put up a picture of the book.

Making free advertisement for your product illegal is part of the most idiotic effects of copyright law.
